1. Terms of use
This web site is owned and operated by Dan Lepard and is made available to you on the following terms and conditions. By using the site and the services available on it you are deemed to accept these terms and conditions and any additional terms and conditions which expressly apply to services and information provided by third parties. You agree that you will not use the Site:
for the posting, uploading, emailing or other transmission of any material which infringes the rights of any person or which is unlawful in any other respect; in any way which is abusive, defamatory or obscene or which will harass, distress or inconvenience any person or which might restrict or inhibit the use and enjoyment of the Site by any person; which will compromise the privacy or data protection rights of any person; for the posting, uploading, emailing or other transmission of any unsolicited or unauthorised advertising, promotional materials, "junk mail", "spam", "chain letters", "pyramid schemes", or any other form of solicitation or commercial exploitation; for the posting, uploading, emailing or other transmission of any material that contains software viruses or any other computer code, files or programs designed to interrupt, restrict, destroy, limit the functionality of or compromise the integrity of any computer software or hardware or telecommunications equipment; to create a database (electronic or otherwise) that includes material downloaded from the Site; to transmit or re-circulate any material obtained from the Site to any third party; or in any way that might bring Dan Lepard or any related companies or employees into disrepute.
2. General
In these terms and conditions:
'Site' means danlepard.com or any other site to which the content of danlepard.com might be transferred or migrated
'Customer' means any person, company, organisation or firm which purchases Services from us;
'Order' means an order for Services in any format and signed by a Customer, including electronic signature in the form of an email or other online medium;
'Services' means all advertising products and services made available by us from time to time;
A job posted on danlepard.com will remain live for at least 30 days, or such shorter time as we agree with the Customer.
3. Payments
All prices exclude VAT but so far as is practicable will also show the total amount including VAT where applicable but these inclusive amounts shall be for guidance only and it is the responsibility of the Customer to ensure payment of the correct amount.
4. Rights Clearances
The copyright, and other rights, in some of the material appearing on the Site may belong to a third party. It is your responsibility to obtain any licences or permissions that may be required to use such material and you agree to pay any costs or expenses incurred by Dan Lepard which arise as a result of your failure to obtain such licences and permissions.
5. Termination
We may terminate the provision of Services if:
the Customer is in material breach of these terms and conditions and has not remedied such breach within ten days of notice specifying the breach and requiring that it be remedied, or:
the Customer becomes insolvent, ceases to trade or goes into liquidation.
6. Limitation of liability
Our total liability to the Customer in respect of any Services is limited to the total amount paid to us for such Services. As required by law, this exclusion does not extend to death or personal injury caused by our negligence.
Whilst every effort has been taken to ensure the accuracy of the information provided by the Site, Dan Lepard and its employees in these pages, the contents of the Site reflect the opinions of the writers and do not necessarily reflect the views and opinions of the Site or Dan Lepard, they are personal to the writer and are naturally subject to change from time to time. Job advertisements contained on the site are provided by prospective employers and their agents and are not reviewed by us. We accept no responsibility or liability for the contents of advertisements and expect candidates and prospective employers to carry out such verification procedures as are customary and prudent in the circumstances.
7. Employment agencies and employment businesses
If you are an employment agency or an employment business (as defined by the Employment Agencies Act 1973 ('the Act')) it is your responsibility to ensure that advertisements you place on the Site comply with your obligations under the Act and Conduct of Employment Agencies and Employment Businesses Regulations 2004. You agree to comply with the Act and these regulations as they affect the conduct of your business and the advertisements you place on the Site.
8. Site rules
We have rules regarding the content and format of jobs posted on the Site. Their purpose is to ensure that users who search the Site get information which is presented as clearly and informatively as possible. You agree that we may, at our discretion and without liability to you, remove from the Site any advertisement which is posted in breach of these rules.
9. Job advertisements
Job advertisements placed on the Site must be for genuine vacancies only, and not for other products or services, either relating to or unrelated to recruitment including, but not limited to, affiliate schemes, pyramid selling schemes or any other so called 'business opportunity'.
10. Legality of advertisements accepted for display on the Site
Advertisements which appear to discriminate on grounds of sex, race or disability are illegal and may result in proceedings being taken against both the advertiser and the publisher. If we believe that an advertisement may be discriminatory we may at our discretion either amend the advertisement or remove it from the Site without liability to you to make any refund of amounts paid or due to be paid in respect of the posting or otherwise and will inform you accordingly.
You agree to deal fairly and professionally with individuals who may respond to an advertisement you have posted and not do anything which may bring the Site or Dan Lepard into disrepute. You will indemnify us from and against any claim brought by an individual against the Site or Dan Lepard arising from your breach of this obligation or any other of these terms and conditions.
11. Suitability of candidates for employment
We do not guarantee any response to your advertisement or that responses will be from individuals suitable for the job advertised. It is your responsibility to carry out such checks and procedures as are necessary to ensure that candidates are suitable for the job advertised and have the required qualifications and personal characteristics.
12. Credit card and debit card payments
The Site provides access to an online payment system operated by PayPal. Please visit PayPal's web site for more information and to satisfy yourself that you agree to use this online payment system on the terms PayPal provide.
13. Acceptance of these terms
By placing an advertisement you accept these terms and conditions as principal, even if you are acting as agent or buyer for the actual advertiser. You are responsible for the content of the advertisement and for ensuring that it complies with all relevant legislation and codes of practice. You will indemnify us against any claim that the advertisement or its content infringes the intellectual property rights or other rights of others or is defamatory or otherwise offensive.
14. Governing law
These terms and conditions shall be interpreted in accordance with English law and all disputes shall be decided by the English courts.
